Acceptable Use, Copyright & AI Disclosure Policy

Rules for content, copyright, AI disclosures, avatar use, and prohibited platform behavior on WOWFLO.AI.

Effective date: 10 June 2026Last updated: 10 June 2026

This page consolidates our Acceptable Use Policy, Copyright & DMCA Policy, and AI Usage & Disclosure Policy.

1. Purpose

This Acceptable Use Policy ("AUP") sets out the rules governing how you may use WOWFLO.AI and the content you may create, store, and publish through it. This AUP exists to protect users, third parties, and the integrity of the Platform.

Violation of this AUP may result in suspension or permanent termination of your account, and where applicable, referral to law enforcement.

This AUP is incorporated into and must be read alongside our Terms of Service.

2. Scope

This AUP applies to:

  • All content created using WOWFLO.AI's tools
  • All content published via the Platform's Instagram integration
  • All uses of AI features, including script generation, voice cloning, and avatar creation
  • All third-party integrations accessed through or alongside the Platform

3. Prohibited Content

You must not create, store, distribute, or publish any content that:

3.1 Is Illegal

  • Violates any applicable law or regulation in your jurisdiction or the United Kingdom
  • Constitutes or facilitates criminal activity
  • Promotes, glorifies, or instructs in illegal activity

3.2 Is Harmful or Hateful

  • Incites hatred, violence, or discrimination on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability, or other protected characteristic
  • Harasses, threatens, intimidates, or bullies any individual or group
  • Promotes self-harm, suicide, or eating disorders

3.3 Is Sexually Explicit

  • Contains pornographic or sexually explicit material
  • Sexualises or depicts minors in any way whatsoever
  • Constitutes or facilitates child sexual abuse material (CSAM) — zero tolerance, immediate termination and report to authorities

3.4 Infringes Third-Party Rights

  • Infringes the copyright, trademark, patent, trade secret, or other intellectual property rights of any person
  • Violates the privacy rights, publicity rights, or data protection rights of any person
  • Contains defamatory, fraudulent, or misleading statements about real people or organisations

3.5 Is Deceptive or Misleading

  • Constitutes misinformation or disinformation
  • Impersonates any person, organisation, or official body
  • Falsely attributes statements, views, or actions to real people
  • Uses AI-generated content to deceive audiences without disclosure

4. Prohibited Activities

You must not use the Platform to:

4.1 Abuse the Platform

  • Circumvent usage limits, subscription restrictions, or access controls
  • Use bots, scrapers, or automated tools to access the Platform beyond what is expressly permitted
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the Platform's operations, servers, or networks

4.2 Conduct Commercial Abuse

  • Resell, sublicense, or commercially redistribute Platform features without authorisation
  • Use the Platform to operate a competing AI content creation service
  • Use the Platform to collect and reuse AI-generated content at scale without authorisation

4.3 Conduct Social Media Abuse

  • Use the Instagram integration to engage in spamming, fake engagement, or mass automated activity
  • Use the Platform to conduct follow/unfollow manipulation, like-botting, or comment flooding
  • Operate multiple fake or impersonation accounts through the Platform
  • Circumvent Instagram's or Meta's rate limits or API restrictions

4.4 Conduct Financial Fraud

  • Use the Platform to facilitate financial fraud, phishing, or identity theft
  • Generate fraudulent invoices, contracts, or financial documents
  • Abuse the refund policy (serial refund requests, chargeback fraud)

5. AI and Synthetic Media Restrictions

5.1 Disclosure Requirement. You must appropriately disclose when content is AI-generated, particularly when publishing to social media. Audiences have the right to know when content is synthetic.

5.2 Misleading Synthetic Media. You must not create synthetic media (including AI-generated video, audio, or images) that:

  • Depicts a real person doing or saying something they did not do or say, without their consent
  • Could reasonably mislead a viewer into believing the content is authentic
  • Is designed to damage a person's reputation, dignity, or safety

5.3 Deepfake Prohibition. Creating deepfakes — realistic synthetic media of identifiable real persons — without those persons' explicit, documented consent is strictly prohibited. This includes public figures, celebrities, and private individuals.

5.4 EU AI Act Compliance. In accordance with EU AI Act Article 52 transparency obligations (which we apply as a global baseline), AI-generated or AI-manipulated content that could plausibly be mistaken for authentic content must be labelled as AI-generated before publication.

6. Instagram and Social Media Use

6.1 Platform Compliance. All content published via the Platform's Instagram integration must comply with:

  • Instagram's Community Guidelines: https://help.instagram.com/477434105621119
  • Meta's Terms of Service: https://www.facebook.com/terms
  • Our Terms of Service

6.2 Automated Publishing. The Platform's scheduling feature allows automated publishing. You are solely responsible for reviewing and approving all content before scheduling. Automated publishing does not reduce your responsibility for the published content.

6.3 Prohibited Instagram Content. You must not use the Instagram integration to publish:

  • Spam or repetitive identical content
  • Misleading health claims or unlicensed financial advice
  • Content that promotes regulated products (alcohol, tobacco, gambling, pharmaceuticals) in jurisdictions where such promotion is prohibited
  • Coordinated inauthentic behaviour or political advertising that violates Meta's policies

6.4 Account Responsibility. You are responsible for the security of your connected Instagram account. We are not responsible for any action taken by Meta against your account as a result of your use of the Platform.

7. Voice Cloning Restrictions

7.1 Own Voice Only. The voice cloning feature is intended solely for creating a synthetic reproduction of your own voice for use in your own content. You must not:

  • Clone another person's voice without their explicit, written consent
  • Use a cloned voice to impersonate another person
  • Create voice content that falsely attributes statements to real individuals

7.2 Consent Requirement. If you wish to create a voice clone of another person (e.g., for an authorised marketing campaign), you must obtain that person's explicit, documented consent and retain records of that consent.

7.3 Public Figures. Cloning the voice of any public figure, celebrity, politician, or other well-known individual is prohibited regardless of intended use, unless you have documented authorisation from that person.

7.4 ElevenLabs Terms. Voice cloning is powered by ElevenLabs. Your use of voice cloning features must also comply with ElevenLabs' Terms of Service and Voice Policy.

8. Avatar and Deepfake Restrictions

8.1 Self-Use Only. Avatar creation through HeyGen is intended for creating an AI representation of yourself. You must not create an avatar based on the likeness of any other person without that person's explicit consent.

8.2 HeyGen Terms. Avatar creation is performed on HeyGen's platform. You must comply with HeyGen's Terms of Service and Content Policy when creating and using avatars.

8.3 Non-Consensual Deepfakes. Creating photorealistic representations of real people for deceptive, harmful, or sexual purposes is strictly prohibited and may constitute a criminal offence in multiple jurisdictions.

8.4 Declaration. By using avatar or voice clone features, you declare that: (a) The face/voice you are using is your own, OR (b) You have obtained explicit written consent from the person whose face/voice you are using, and you retain records of that consent.

9. Compliance with Third-Party Terms

Your use of the Platform involves third-party services including Anthropic (Claude), ElevenLabs, HeyGen, Meta/Instagram, and Stripe. You must comply with the acceptable use and terms of service of each of these providers. Violating third-party terms through our Platform is also a violation of this AUP.

10. Enforcement

10.1 Investigation. We reserve the right to investigate suspected violations of this AUP and to take appropriate action.

10.2 Actions. Upon finding a violation (or reasonable suspicion thereof), we may:

  • Issue a warning
  • Suspend access to specific features
  • Suspend your account pending investigation
  • Permanently terminate your account without refund
  • Remove or disable access to content
  • Report to law enforcement or regulatory authorities
  • Seek legal remedies

10.3 No Obligation. We are not obligated to monitor user content but reserve the right to do so. We act on reports and credible information.

10.4 Cooperation. We cooperate with law enforcement and regulatory authorities. We will respond to valid legal requests for user data in accordance with our Privacy Policy and applicable law.

WOWFLO.AI maintains a repeat infringer policy. Accounts that receive multiple valid copyright infringement notices will face:

  • Warning after first substantiated notice
  • Temporary suspension after second substantiated notice
  • Permanent account termination after third substantiated notice

We assess each case individually and reserve the right to accelerate this process where there is clear and systematic copyright infringement.

Type of AI: AI video generation and avatar synthesis
How it connects: You connect your own HeyGen account to WOWFLO.AI by entering your personal HeyGen API key in your account settings. WOWFLO.AI makes API calls using your key on your behalf — there is no shared WOWFLO.AI API key. You must hold a valid HeyGen subscription independently.
Data processed: Your facial images, video, and other content you submit via your HeyGen account. WOWFLO.AI does not store this data; it is processed directly by HeyGen under your HeyGen account.
⚠️ AI Training — Important Disclosure: HeyGen's Terms of Service (Section 3, last updated May 2026) contain the following clause: "you grant us a license to...train or otherwise improve or modify our artificial intelligence and machine learning models." This means that content you create through your HeyGen account — including avatars, videos, and uploaded images — may be used by HeyGen to train their AI systems. This is HeyGen's policy and applies to your direct relationship with HeyGen, independent of WOWFLO.AI.

All content produced through WOWFLO.AI is AI-generated or AI-assisted. You are responsible for reviewing and approving all outputs before publishing.

4. Transparency and Disclosure Requirements

4.1 Your Disclosure Obligation. When you publish AI-generated content to Instagram or any other platform, you may be required to:

  • Comply with that platform's AI content labelling requirements (Meta requires AI-generated labels on realistic synthetic media)
  • Comply with applicable law in your jurisdiction requiring disclosure of AI-generated content
  • Honour your own audience's expectations of authenticity

4.2 Meta/Instagram Requirement. Meta's policies require that AI-generated content (including AI-generated video and audio) be labelled appropriately when posted on Instagram. Failure to label AI-generated content may result in Meta adding its own label or taking action on your account.

4.3 EU AI Act (Article 52). Under EU AI Act Article 52, operators of AI systems that generate synthetic media (images, audio, video) must ensure the output is labelled as AI-generated. While WOWFLO.AI is a UK company, we apply this as a global baseline standard. You should label all content generated through WOWFLO.AI as AI-generated before publishing.

4.4 Recommended Disclosure Language. We recommend using labels such as:

  • "Made with AI"
  • "AI-generated content"
  • "Created using AI tools"
  • "#AIgenerated" (for social media)

5. Data Used by AI Systems

When you use AI features, your inputs are transmitted to the relevant AI provider's systems:

Script generation (Claude): Your topic prompts, content preferences, and text inputs are sent to Anthropic. Anthropic's data use policy governs how this data is handled.

Voice synthesis (ElevenLabs): Your voice recordings are sent to ElevenLabs for processing. Voice data is biometric data and transmission occurs only after your explicit consent.

Avatar generation (HeyGen): You connect your own HeyGen account via your personal API key. WOWFLO.AI executes API calls using your key. All facial, video, and avatar data is processed by HeyGen under your direct account relationship with them. WOWFLO.AI does not store this data. Note that HeyGen may use this content to train their AI models — see Section 7 for full disclosure.

We do not store your prompts or AI outputs beyond what is necessary to operate the Platform, except as disclosed in our Privacy Policy.

6. Biometric Data and AI

The following features involve biometric personal data (data relating to physical characteristics that can uniquely identify a person):

Voice Cloning (ElevenLabs)

  • Processing voice recordings to create a voice model is biometric data processing
  • We obtain your explicit consent before activating this feature
  • You may withdraw consent at any time — contact info@wowflo.ai
  • Biometric voice data is processed and retained by ElevenLabs under their policies

AI Avatar (HeyGen)

  • Using your facial image or video to generate an avatar may constitute biometric data processing
  • This processing occurs on HeyGen's platform under their privacy policy
  • Before being redirected to HeyGen, you will be shown an information notice

Illinois BIPA (US users): If you are in Illinois, the Illinois Biometric Information Privacy Act requires specific disclosures and consent for biometric data collection. By using these features, you acknowledge this notice and consent to the collection and transmission of biometric data as described.

7. AI Training and User Data

WOWFLO.AI's position: Ecom Flip Limited does not use your content, prompts, or voice recordings to train its own AI models. We do not have proprietary AI models. We do not sell your data to AI training companies.

Third-party AI providers: Each provider has its own policy on whether and how they use data for AI training. Below is a transparent summary based on their current published terms:

Anthropic (Claude) — Script Generation

By default, Anthropic does not use API inputs to train their models. API data is not retained for training purposes under their standard API terms. This is one of the reasons we chose Anthropic for script generation.
Source: https://www.anthropic.com/privacy

ElevenLabs — Voice Synthesis

ElevenLabs' data use for training depends on your account tier and the consent settings within your ElevenLabs account. Review their current Voice Policy and adjust your data settings at https://elevenlabs.io/privacy.

HeyGen — Avatar Generation ⚠️ Important

HeyGen's Terms of Service (Section 3, as of May 2026) grant HeyGen an explicit, broad licence to use content you create on their platform for AI training purposes. The exact wording is:

"you grant us a license to access, use, host, cache, store, reproduce, transmit, display, publish, distribute, and modify Your Content to operate, improve, promote and provide the Services and to develop new services and products, including to train or otherwise improve or modify our artificial intelligence and machine learning models."

What this means for you:

  • Avatars, videos, facial images, and other content you create through your HeyGen account may be used by HeyGen to train their AI
  • This applies to users on HeyGen's Creator, Pro, and Business plans
  • This is HeyGen's own policy — it exists in your direct relationship with HeyGen and is outside WOWFLO.AI's control
  • WOWFLO.AI discloses this so you can make an informed decision before connecting your HeyGen API key

What you can do:

  • Review HeyGen's current privacy settings in your HeyGen account dashboard
  • Contact HeyGen directly at support@heygen.com to ask about opting out of AI training use
  • Review HeyGen's privacy policy at https://www.heygen.com/privacy for the most current terms

We include this disclosure in full because we believe you have the right to know exactly how your data is used by every system connected to WOWFLO.AI.

8. Limitations of AI-Generated Content

AI systems, including those used by WOWFLO.AI, have known limitations:

Accuracy: AI may generate factually incorrect information. Scripts and text must be reviewed for accuracy before publication.

Copyright: The copyright status of AI-generated content is legally uncertain in many jurisdictions and is actively evolving. We cannot guarantee that AI-generated content is free from third-party IP claims.

Bias: AI language and image models may reflect biases present in their training data. Review all outputs critically.

Consistency: AI outputs may vary between sessions. Results are not guaranteed to be consistent.

Legal Compliance: AI-generated content does not automatically comply with advertising standards, regulatory requirements, or platform policies. You are responsible for ensuring compliance.

9. Human Review and Responsibility

WOWFLO.AI is a tool. You are the creator.

All AI-generated content must be reviewed by a human before publication. You are solely responsible for:

  • Reviewing AI outputs for accuracy, appropriateness, and compliance
  • Editing AI-generated scripts, voiceovers, or video before use
  • Ensuring published content complies with Instagram's policies, applicable advertising standards, and law
  • Obtaining any necessary clearances for content before publication

We are not liable for errors, inaccuracies, legal issues, or platform violations arising from AI-generated content that was published without adequate human review.

10. EU AI Act Compliance

The EU AI Act (Regulation (EU) 2024/1689) introduces requirements for AI systems operating in or targeting users in the European Union. WOWFLO.AI uses AI Providers who operate under their own AI Act compliance frameworks.

As a user of WOWFLO.AI who may publish content to EU audiences, you should be aware that:

  • Synthetic media (AI-generated video, audio, images) targeting EU audiences must be labelled as AI-generated (Article 52 obligation)
  • Using deepfake or impersonation technology to deceive may violate Article 52 and local law
  • We apply EU AI Act transparency standards as a global baseline

We are not an AI system provider under the EU AI Act; we are an application layer using third-party AI systems. Compliance obligations relating to AI providers are managed by Anthropic, ElevenLabs, and HeyGen under their respective compliance programmes.

11. Restrictions on AI Use

You must not use WOWFLO.AI's AI features to:

  • Generate content that is illegal, harmful, hateful, or defamatory
  • Create synthetic media designed to deceive or defraud
  • Clone voices or generate avatars without consent
  • Create content impersonating real individuals
  • Circumvent AI safety guidelines or content restrictions of any AI Provider
  • Produce misinformation or disinformation
  • Generate spam, phishing content, or fraudulent communications

Violation of these restrictions is a violation of our Acceptable Use Policy and may result in account termination and referral to law enforcement.

12. AI Provider Compliance

WOWFLO.AI uses AI services in compliance with each provider's terms. We:

  • Do not misrepresent AI-generated content as human-created in our own communications
  • Do not attempt to circumvent AI safety filters
  • Comply with usage policies of each AI Provider

Users must similarly comply with AI provider terms when using features powered by those providers.

13. Changes to AI Systems

We may add, change, or remove AI providers or features over time. Where material changes affect data processing or your rights, we will provide advance notice via email or in-app notification.
